Papsoo’s enforcement policy addresses user disputes or account issues:

3. Account and Security

To use many features on Papsoo, you need an account. Here’s what that entails:

  • Responsibility for Account: Users must keep their accounts secure. This means protecting your login credentials and being responsible for all activity under your account.
  • Eligibility and Age Requirements:
    • If under 18, you need parental supervision.
    • Some products (like alcohol) are restricted to legal adults.

4. Fees and Taxes

  • Seller Fees: These are listed on Papsoo’s Selling Fees page and include any transaction fees or listing costs. Papsoo can change fees with five days’ notice.
  • Payment Due Dates and Late Fees: Sellers must keep a valid payment method on file and pay fees on time to avoid late fees. Late or missed payments can affect credit scores if reported to credit bureaus.
  • Sales Tax: In regions where Papsoo is required to collect sales tax, they will do so through your account, with the amount shown at checkout.

Papsoo may display third-party advertisements (including links and references thereto) or other content in any part of its Services, in its sole discretion and without consent from, or payment, fee reduction, or other credit to, sellers.

5. Purchase Conditions

When buying through Papsoo, there are specific rules and responsibilities:

  • Buyer’s Responsibility: Buyers should read listings carefully to understand what they’re purchasing, including item details and terms.
  • Non-Binding Bids: For certain items, like real estate or motor vehicles, bids or offers may indicate serious intent but do not establish a formal contract unless finalized.
  • Ownership: Legal ownership of purchased items transfers from the seller to the buyer, not Papsoo. Papsoo facilitates the sale but does not take ownership.

6. Listing Conditions

For sellers, Papsoo requires compliance with listing policies to keep the marketplace fair and safe:

  • Accuracy and Responsibility: Sellers are accountable for listing details, such as item descriptions, conditions, and images.
  • Listing Visibility: Although Papsoo strives to display listings promptly, they may take hours to appear and cannot guarantee placement or prominence in search results.
  • Compliance with Policies: Items that are illegal or recalled by government agencies should not be listed. Sellers bear full responsibility for product safety and for complying with public recalls.

Papsoo reserves the right to modify listing content to ensure accuracy and compliance.

7. User Content (Reviews, Comments, Communications)

Users can post content, but there are rules:

  • Content Standards: Content must be legal, respectful, and relevant. No defamatory, infringing, or inappropriate content is allowed.
  • License Grant: By posting, you give Papsoo permission to use, reproduce, and distribute your content worldwide without paying royalties. This license allows Papsoo to use content like reviews, comments, and shared media.
  • Monitoring and Removal: Papsoo may remove content that violates policies but is not responsible for monitoring all posts.

8. Holds and Restricted Funds

Papsoo may hold funds in seller accounts to manage risks:

  • Restricted Funds: If there are concerns (such as potential fraud or disputes), Papsoo may restrict access to a seller’s funds. This precaution helps protect both the platform and buyers.

9. Third-Party Services and Links

Papsoo provides access to some third-party products and services:

  • Independent Responsibility: Purchases with third-party providers or sellers are independent of Papsoo, so Papsoo is not responsible for these providers’ services, content, or products.
  • Liability Limitation: Users are advised to review third-party privacy policies and terms before engaging, as Papsoo cannot guarantee the quality or security of these services.

10. Dispute Resolution and Arbitration

Disputes involving Papsoo are generally resolved through binding arbitration:

  • Arbitration Process: If there’s a disagreement, users must follow the arbitration process, which is managed by the American Arbitration Association (AAA). Arbitration avoids traditional court proceedings and usually involves a neutral arbitrator. The arbitration will be conducted by the American Arbitration Association (AAA) under its rules, including the AAA's Supplementary Procedures for Consumer-Related Disputes. The AAA's rules are available at www.adr.org or by calling 1-800-778-7879. Payment of all filing, administration, and arbitrator fees will be governed by the AAA's rules.
  • Fees: Papsoo covers arbitration costs for claims under $10,000 unless found frivolous. Users may choose arbitration via phone, written submissions, or in-person hearings.
  • Class Action Waiver: Disputes are handled individually, and users cannot join together in class actions or group lawsuits.

If litigation is permitted, both parties waive the right to a jury trial, but court action can be taken for intellectual property violations.

11. Disclaimer of Warranties and Limitation of Liability

Papsoo provides services “AS IS” without warranties:

  • Warranty Disclaimers: Papsoo does not guarantee uninterrupted service, error-free operation, or specific outcomes. Users agree to use the platform at their own risk.
  • Limitation of Liability: Papsoo limits its liability to the fullest extent permitted by law and is not responsible for any indirect or incidental damages, including lost profits or data loss.
